Public offer for SMM Posting services

This document is a public service offer of ООО «Гид Групп» (the Provider) governing paid access to the SMM Posting online service available at https://smmposting.com and related information-technology services. This English text is provided for convenience; where required by Russian law, the Russian-language version published on smmposting.ru prevails.

1. Service and scope

SMM Posting is a web service for content planning, sources and imports, team approval, publication to supported social networks and messengers, available analytics, automation and AI-assisted content workflows.

The Provider grants the Customer a non-exclusive right to remotely use SMM Posting within the selected plan and paid access period. Features, project limits, supported channels, price and other parameters are those shown in the Service interface when the order is created.

2. Acceptance

For paid services, this offer is accepted when the Customer pays an order created in SMM Posting. By paying, the Customer confirms that the selected plan, price, access period, optional auto-renewal terms, this offer and the Privacy Policy have been reviewed.

3. Functionality

Depending on the current version and plan, the Service may provide a content calendar, VK, Odnoklassniki, Telegram, MAX, YouTube, TikTok and other supported channels, Google Sheets and RSS sources, file imports, media storage, approvals, team roles, automation, analytics, reports, notifications and AI tools.

External integrations require permissions, tokens or other access data supplied by the Customer. Availability depends on third-party APIs, rules, restrictions and technical status.

Customers register with SMM Posting themselves and connect external platform accounts they own or are authorized to manage. Customers grant the required access permissions and confirm that they have authority to use the connected accounts.

Customers create, upload or select publication content, or set rules for its preparation using AI and automation, choose destinations and publication times, and arrange for content review before use. When enabling automatic content preparation or delivery, Customers set the relevant rules and settings and must monitor their results. Enabling automation does not mean that every publication necessarily receives separate manual approval.

SMM Posting performs technical content preparation, scheduling and delivery operations according to Customer settings and available Service functions.

3.1. Instagram, Facebook and Threads integrations and legal restrictions

Instagram, Facebook and Threads are products of Meta Platforms Inc. In the Russian Federation, Meta Platforms Inc. activities involving the Facebook and Instagram social networks have been designated extremist and prohibited. Restrictions applicable to Threads and other resources are determined by current law and acts of competent authorities; common ownership does not establish that a particular use is lawful.

References to these platforms and the presence of an integration describe the technical compatibility of SMM Posting. They do not authorize prohibited activity, establish the lawfulness of a specific publication or imply affiliation with the platform owner. Customers may use these functions only where permitted by applicable law. The Service is not intended to circumvent legal restrictions.

The Service must not be used to distribute advertising on information resources where such distribution is prohibited by applicable law, including Article 5(10.7) of Russian Federal Law No. 38-FZ of March 13, 2006, On Advertising. This also applies to relevant prohibited or restricted resources even when their technical integration remains available. Advertising labels, advertising identifiers, authorization from the account owner and payment for a plan do not remove this prohibition.

Whether content constitutes advertising is assessed according to its substance, purpose and circumstances of distribution under applicable law. Mentioning a product or brand, a price, a discount or a link does not, by itself, determine that classification. A post type selected in the Service, a not-advertising label, publication on a page managed by the account owner or the absence of payment for the publication does not independently establish that the publication is permissible.

Before scheduling content, Customers must assess its substance, whether it constitutes advertising and whether its distribution on the selected resource is permitted. AI functions, checks and Service statuses do not replace this assessment or provide a legal opinion. Lawfulness depends on the content and circumstances of distribution, not the name or interface label assigned to the material.

The Provider may stop an affected publication, restrict the relevant integration or take other measures under section 14. Customer responsibility clauses do not exclude or limit the Provider obligations or liability under mandatory law. Restricting an integration or stopping a publication does not, by itself, determine entitlement to a refund of the fees paid for access to SMM Posting. Refund requests are considered under section 11 of this offer and applicable law.

4. Plans and payment

Paid access is provided for the period stated at checkout. Prices are those shown immediately before payment. Future prices or plan composition may change without recalculating an already paid period.

Payments are processed through Robokassa or another payment method explicitly offered in the interface. SMM Posting does not receive or store full bank-card details. It stores the technical payment result, amount, transaction identifiers and accounting information required to activate and administer the service. An electronic fiscal receipt is issued where required by law.

5. Auto-renewal

Auto-renewal is optional and is activated only by an explicit Customer choice where recurring payments are supported. The Customer can disable it at any time; an already paid period remains active until its expiration date.

6. AI balance and own API keys

The AI balance is an internal prepayment accounting mechanism for operations performed through SMM Posting's system AI connection. It is not a bank account, electronic wallet or deposit. OpenRouter Free, a personal API key or a project API key does not consume the system AI balance when the interface expressly indicates that mode.

7. Customer responsibilities and content requirements

• provide accurate account and payment information;
• ensure that materials created, uploaded, scheduled or published through the Service comply with the applicable laws of the Russian Federation, including applicable advertising and information-distribution requirements;
• comply with the terms, content policies, advertising requirements and publishing rules of each social network, messenger or other external platform to which the Customer sends content through the Service;
• obtain all rights, permissions and consents required for texts, images, video, music, trademarks, personal data and other materials;
• not use the Service for spam, unlawful activity, distribution of information prohibited or restricted by law, infringement of third-party rights, or circumvention of external-platform restrictions;
• protect credentials and revoke unnecessary external permissions;
• review publications, schedules and automation results before commercially or legally significant use.

The Customer is responsible for the content and legality of materials created, uploaded, scheduled or published through SMM Posting. The technical ability to create, schedule or send material through the Service does not constitute confirmation that it complies with Russian law, an external platform's rules or third-party rights.

8. AI and automation

AI-generated or AI-suggested material is auxiliary. The Customer must verify facts, wording, usage rights and platform compliance. The Provider does not guarantee uniqueness, absence of errors or fitness of an AI result for a particular purpose.

9. External platforms and limitation of liability

SMM Posting does not control third-party APIs and does not guarantee their permanent availability, successful moderation, reach, follower growth, sales, leads or other marketing outcomes. If a network request has an uncertain result, the Service may block an automatic repeat where repeating could create a duplicate.

10. Service delivery and acceptance

Access is considered provided from activation of the paid period and throughout that period. Failure to use available functionality does not by itself mean that access was not provided. Service-side availability issues should be reported through Support or to info@smmposting.ru.

11. Refunds

Refund requests are considered under applicable Russian law, taking into account the type of service, period of access actually provided and circumstances of the request. This offer does not establish an unconditional no-refund rule.

12. Intellectual property

Rights to SMM Posting software, interface, design and databases belong to the Provider or relevant rights holders. Customer content remains with the Customer or its rights holder; the Provider receives only the technical rights necessary to operate selected Service functions.

13. Personal data

Personal data is processed under the Privacy Policy.

14. Changes, suspension and termination

The Provider may develop and change the Service. If the Provider identifies a violation of Russian law, the rules of a connected social network or other external platform, third-party rights, Service security requirements or this offer, the Provider may stop or cancel the affected publication, temporarily restrict individual functions or connected channels, suspend relevant services, and request information from the Customer.

For a material, repeated or intentional violation, or where continued use creates a risk of suspension of the SMM Posting application, restriction of its external API access, harm to other users, or breach of mandatory legal requirements, the Provider may suspend services and temporarily or permanently block the Customer account. Where delay could allow the violation to continue or immediate action is required by an external platform or competent authority, such measures may be applied without prior notice.

Payment, refund and paid-access consequences of such measures are handled under this offer and applicable Russian law.
